Informal probate (i.e., uncontested probate) is a more streamlined process. Informal probate is best when there are no disputes and does not involve a judge. Specifically, if all four of the following items can be checked off, then it is most likely best to use informal probate.

  • All interested parties are in agreement that the will is valid or that the deceased did not leave a will.
  • All parties must be united in selecting the same personal representative to manage the estate, ensuring no disputes over who should take on this role.
  • A shared trust and cooperation with the chosen personal representative is also a must.
  • A generally amicable relationship among the involved parties is crucial.

2. Formal Probate

Formal probate (i.e., contested probate) is a court proceeding involving a judge when there is a dispute of some kind.
