- All interested parties are in agreement that the will is valid or that the deceased did not leave a will.
- All parties must be united in selecting the same personal representative to manage the estate, ensuring no disputes over who should take on this role.
- A shared trust and cooperation with the chosen personal representative is also a must.
- A generally amicable relationship among the involved parties is crucial.
2. Formal Probate
Formal probate (i.e., contested probate) is a court proceeding involving a judge when there is a dispute of some kind.
